Scope of Work
Aqua-men Pool Construction agrees to provide pool construction services to the client as per the agreed-upon specifications and requirements outlined in the contract.
Payment Terms
The client agrees to pay Aqua-men Pool Construction the agreed-upon sum for the pool construction services rendered. Payment terms will be outlined in the contract and may include a deposit, progress payments, and final payment upon completion.
Change Orders
Any changes to the scope of work requested by the client must be documented in writing and approved by both parties. Additional charges may apply for change orders, and the timeline for project completion may be adjusted accordingly.
Permits and Approval
Aqua-men Pool Construction will obtain all necessary permits and approvals required for the construction of the pool. Any fees associated with permits and approvals will be the responsibility of the client.
Warranty
Aqua-men Pool Construction warrants its workmanship and materials used in the construction of the pool for a period specified in the contract. This warranty does not cover damage caused by misuse, neglect, or acts of nature.
Completion Date
Aqua-men Pool Construction will make reasonable efforts to complete the pool construction within the agreed-upon timeline. However, unforeseen circumstances such as weather delays or permitting issues may impact the completion date.
Sites Access and Preparation
The client is responsible for providing access to the construction site and ensuring that it is clear and ready for construction to commence. Any site preparation work required beyond the scope outlined in the contract may incur additional charges.
Liability
Aqua-men Pool Construction will take reasonable precautions to prevent damage to the client’s property during the construction process. However, the client acknowledges that some disruption and damage may occur, and Aqua-men Pool Construction will not be held liable for such damage unless it results from negligence on the part of Aqua-men Pool Construction.
Indemnification
The client agrees to indemnify and hold harmless Aqua-men Pool Construction from any claims, damages, or liabilities arising out of the construction of the pool, except those resulting from the negligence or misconduct of Aqua-men Pool Construction.
Termination
Either party may terminate the contract for breach of its terms with written notice to the other party. In the event of termination, the client agrees to compensate Aqua-men Pool Construction for work completed up to the date of termination.
Dispute Resolution
Any disputes arising out of or relating to this contract shall be resolved through arbitration in accordance with the laws of [State/Country], with each party responsible for their own legal fees.
Entire Agreement
This contract constitutes the entire agreement between the client and Aqua-men Pool Construction and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
By signing below, the client acknowledges that they have read, understood, and agree to abide by the terms and conditions outlined above.
